End User License Agreement

This End User License Agreement ("Agreement") is a legal agreement between you and Fingees LLC ("Fingees", "we", "us", or "I") for the game Seconds Until You Die (the "Game"). By downloading, installing, or playing the Game, you agree to this Agreement. If you do not agree, do not download, install, or play the Game.

1. License

I grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and play the Game for your own non-commercial entertainment, on devices you own or control, subject to this Agreement and the rules of the platform you obtained it from.

2. Restrictions

You agree not to:

• sell, rent, sublicense, or redistribute the Game;
• reverse engineer, decompile, or modify the Game except where the law expressly permits it;
• use cheats, exploits, or automation in a way that harms other players or the Game's services; or
• use the Game for any unlawful purpose.

3. Ownership

The Game, including all code, art, audio, and other content, is owned by me or my licensors and is protected by intellectual property laws. This Agreement gives you a license to play the Game; it does not transfer any ownership to you.

4. No warranty

The Game is provided "as is" and "as available", with all faults and without warranty of any kind. To the fullest extent permitted by law, I disclaim all warranties, express or implied, including any warranties of merchantability, fitness for a particular purpose, and non-infringement. I do not warrant that the Game will be uninterrupted, error-free, secure, or free of harmful components.

5. No liability / no responsibility

To the fullest extent permitted by law, I accept no responsibility or liability whatsoever for any damages of any kind arising out of or related to the Game, including but not limited to direct, indirect, incidental, special, consequential, or punitive damages, loss of data, loss of profits, device damage, or service interruption, even if I have been advised of the possibility of such damages. Where liability cannot be excluded by law, my total liability is limited to the amount you actually paid for the Game, if any.

6. Third-party services

The Game may connect to third-party platforms and services (such as app stores, Google Firebase, multiplayer providers, and Discord). Your use of those services is governed by their own terms, and I am not responsible for them.

7. Apple App Store

If you download the Game from the Apple App Store, Apple's standard Licensed Application End User License Agreement (the "Apple Standard EULA") also applies and is available at apple.com/legal/internet-services/itunes/dev/stdeula. To the extent the Apple Standard EULA conflicts with this Agreement for App Store downloads, the Apple Standard EULA controls. You acknowledge that Apple has no obligation to provide support or maintenance for the Game, and that Apple and its subsidiaries are third-party beneficiaries of this Agreement entitled to enforce it against you.

8. Termination

This Agreement and your license end automatically if you breach it. You may end it at any time by uninstalling and deleting the Game. On termination, you must stop using and delete the Game.

9. Governing law

This Agreement is governed by the laws of the State of New York and applicable United States federal law, without regard to conflict-of-law rules. The courts located in New York shall have jurisdiction over any dispute, except where the Apple Standard EULA provides otherwise for App Store downloads.

10. Changes

I may update this Agreement from time to time. Continued use of the Game after changes are posted means you accept the updated Agreement.
